1. Acceptance of Terms

By accessing or using Thumix ("the Service"), provided by Cloud Dream, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

Thumix is an AI-powered platform for generating image thumbnails from user text prompts. We rely on third-party AI models to produce these images.

3. User Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

4. Credits & Payments

The Service operates on a credit system. Credits are purchased through Stripe and consumed when you generate images. Credit purchases are non-refundable, except where required by law or at our sole discretion, including for generations blocked by our Acceptable Use policy (Section 5).

5. Acceptable Use

You agree not to submit, generate, or attempt to generate content that:

  • Contains nudity, sexual, or otherwise NSFW material
  • Is illegal, harmful, abusive, harassing, or defamatory
  • Infringes the intellectual property or other rights of others
  • Violates applicable content-safety standards or is flagged by our safety filters

Content is screened automatically by our AI safety systems. Violations may result in restriction or termination of your account, and credits are not refunded for generations blocked on these grounds. If you believe content was flagged in error, contact support for manual review.

6. Intellectual Property

  • Your Content: Subject to the terms of our underlying AI providers, you own the images you generate using Thumix. We claim no ownership over your generated content.
  • Our IP: All platform content provided on the Service — including its text, graphics, logos, software, design, and branding — is the property of Cloud Dream, LLC or its suppliers and is protected by intellectual property laws.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that AI-generated images will meet your requirements or be error-free, and due to the nature of AI, generated content may occasionally be unpredictable or inappropriate.

8. Limitation of Liability

To the fullest extent permitted by law, Cloud Dream, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and your continued use of the Service constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
